If you’re a private employer with 100 or more employees or a federal contractor with 50 or more employees, now is the time to get organized. You’ll need to report employee data by job category, sex, and race/ethnicity to the Equal Employment Opportunity Commission (EEOC) during the short reporting window.

📣 What’s New in 2024?
This year’s reporting portal opens with a personal message from Andrea Lucas, the EEOC’s new Acting Chair, reminding employers of their core obligations under Title VII of the Civil Rights Act. Key takeaways include:
- Avoid Discrimination: Do not make employment decisions based on an employee’s race, sex, or any other protected characteristic.
- Use Demographic Data Responsibly: The data you report must never be used to justify discriminatory practices.
- Title VII Applies Equally: Protections are for all employees — regardless of their background.
- No “Diversity” Loophole: There is no exception in Title VII for diversity-related employment actions that result in unlawful discrimination.

- Select Your Workforce Snapshot Date
Choose a payroll end date between October 1 and December 31, 2024. You’ll report all employees on your payroll as of that date.
⚠️ Note: If your company had 100 or more employees at any time during Q4, you’re required to file — even if you had fewer than 100 on the chosen date.
- Categorize Employees by Job Classification
Ensure all positions align with the EEOC’s job categories:
- Executive/Senior-level Officials & Managers
- First/Mid-level Officials & Managers
- Professionals
- Technicians
- Sales Workers
- Administrative Support Workers
- Craft Workers
- Operatives
- Laborers & Helpers
- Service Workers
- Allow Employees to Self-Identify Demographics
Provide employees the chance to voluntarily identify their race/ethnicity and sex using the EEOC’s defined categories.
⚠️ For 2024, only binary gender options (male/female) are accepted — non-binary data will not be processed.
- Assign a Filing Contact
Designate a responsible individual to act as your EEO-1 account holder and manage the submission. Reports must be filed through the Online Filing System (OFS) using either manual entry or file upload. The certifying official will then complete final submission.
- Don’t Wait — File Early!
The system often slows down as the deadline nears, so we recommend submitting well ahead of June 24. Extensions are rarely granted.
