On April 2, 2025, the U.S. Citizenship and Immigration Services (USCIS) rolled out an updated version of Form I-9. While it includes a few terminology changes, employers can breathe easy—you can still use the current version of the form if you prefer.
What’s New in the April Update?
Here’s a quick rundown of the changes on the new Form I-9:
- The term “noncitizen” has been updated to “alien”
- “Gender” is now labeled as “sex”
- A fresh edition date: 1/20/25
The I-9 Instructions have also been updated with these terminology changes, along with a revised Department of Homeland Security (DHS) Privacy Notice. These changes will also show up in E-Verify and E-Verify+ starting April 3, 2025.
What Do Employers Need to Do?
Nothing at the moment! The updated Form I-9 is optional, and the current 8/1/23 versions are still valid through 2026 and 2027.
If you’re using E-Verify, just be aware:
There’s now a mismatch in terminology between the form and the system. If an employee selects “a noncitizen authorized to work” on the 8/1/23 Form I-9, you’ll need to select “an alien authorized to work” in E-Verify to stay consistent.
